# Flight missing

Hi, i was on a flight EZY8341 on 4th september from gatwick to naples. Flight was delayed overnight, we were told due to a valve of aircrafts break system. Now easyjet is trying to avoid compensation as mentioning this : “To further explain what happened on the day; air traffic control restrictions substantially regulated the air space, which resulted in long delays to flights as aircraft waited for air space ‘slots’ to operate, sometimes for several hours. Ultimately and in the case of this flight, the delays pushed our crew into their maximum legal operating hours. There are strict industry wide rules on the number of hours our crew are allowed to work. To protect the safety of our customers and crew, these hours cannot be exceeded. This delay pushed your flight into the curfew at Naples which meant we had no option but to delay your flight overnight. We do take reasonable measures to avoid delays and cancellations to our flights by having replacement crews and spare aircraft available in our network. In the circumstances, these options were not possible as the delay to your flight was a direct result of air traffic control restrictions.”

This was never mentioned on the day, in fact aircraft had to be carried to the gate and there was firefighter and engineer called. Now i cannot find the flight over here, any help i am new, any related info would be great

There’s no flight listed on the 4th with that flight number so that flightplan wasn’t submitted (and then you don’t see the cancellation).

Any way to find out info about it? I stupidly didn’t do screenshot on the day for the reason mentioned and I don’t have actual proof as didn’t make any video to the crew mentioning the problem. But it was never about the slot from what we were told

I was also a passenger on EZY8341 from Gatwick to Naples on 4 September 2026. The captain told us that there was a technical problem with the aircraft and that it had to be towed back to the gate. I am currently disputing easyJet’s refusal of EU/UK261 compensation, as easyJet says the overnight delay was caused by ATC restrictions.

If any other passengers from this flight are here, I would be interested in comparing our recollections of what happened.

Yeah this cheap b are trying no to pay compensation making up excuses

This is what i sent

Thank you for your response regarding my flight EJU8431 / U28341 London Gatwick (LGW) to Naples (NAP) on 4th September 2026.

I do not accept your explanation of ATC restrictions, and I am requesting you reconsider compensation under UK261 (retained EU261).

What actually happened on the day, announced to all passengers:

1. The cabin crew announced an issue with a valve of the aircraft’s brake system.

2. The captain confirmed this on the PA.

3. An engineer and the airport fire crew attended the aircraft.

4. We were then informed we were waiting for the aircraft to be transported/towed back to the dock/stand.

This is a clear technical fault requiring a return-to-stand procedure. An ATC airspace slot delay does not require an engineer, fire crew, or a tow back to the dock. These actions are only taken for a technical defect.

Your email now states the cause was ATC restrictions leading to crew hours and Naples curfew. This directly contradicts the contemporaneous explanation given by your own crew on the aircraft. The crew hours/curfew issue was a direct knock-on consequence of the initial technical delay, which remains within the airline’s control under UK261. Per CAA guidance and CJEU case law (e.g., Wallentin-Hermann), routine technical faults do not constitute extraordinary circumstances.

This flight EJU8431 on 04/09/2026 arrived in Naples overnight delayed, more than 3 hours late. The route LGW-NAP (1592km) falls into the €400(350£) compensation band.

I therefore request:

1. Compensation of 350£ per passenger under UK261 for the delay.

2. Reimbursement of duty of care expenses: [i submitted those with receipt on the expenses form].

To support your claim of extraordinary circumstances, please provide as required by UK261burden of proof:

a) The Aircraft Technical Log for the brake valve defect on this aircraft on 04/09/2026

b) The Ground Handling log showing the reason for the tow back to stand/dock

c) The Eurocontrol ATFM / CFMU slot delay message for this specific flight showing the ATC regulation

If I do not receive satisfactory evidence or payment within 14 days, I will escalate the claim to AviationADR, your CAA-approved Alternative Dispute Resolution provider, without further notice.

Yes , AI help , it suggested to keep the email trail proof so that we can submit that to the ADR in case they don’t pay. Also if you have any proof pictures on the day can you send it here? Unfortunately i didn’t take any but my brother has a screenshot mentioning a technical problem with the aircraft, that s all i have.

Unfortunately, I don’t have any screenshots and all the messages I received have been delated. Your screenshot looks very helpful, though it doesn’t have any indication about the flight number or any details of the flight.

I sent a response to the same email address of the customer service written with AI support.

- Dear easyJet Customer Services,I am writing to formally request a further review of my claim for compensation concerning flight EZY8341/U28341 from London Gatwick (LGW) to Naples (NAP) on 4 September 2026.I acknowledge your previous response stating that the overnight delay was caused by air traffic control restrictions, which allegedly resulted in the crew reaching their maximum legal operating hours and subsequently caused the flight to be affected by the Naples airport curfew.However, I do not consider that explanation sufficient to establish that the delay giving rise to my compensation claim was wholly attributable to an extraordinary circumstance.There is a significant discrepancy between the explanation communicated to passengers on board at the time and the explanation subsequently provided by easyJet. During the disruption on board, passengers were informed that there was a technical issue affecting the aircraft. In particular, the cabin crew referred to an issue involving a valve in the aircraft’s braking system, and the captain subsequently confirmed the technical problem to passengers over the PA system. An engineer and airport fire crew attended the aircraft, and passengers were subsequently informed that the aircraft had to be transported/towed back to the stand.I personally witnessed these events and therefore ask easyJet to address them specifically rather than providing a general explanation concerning ATC restrictions affecting the network.These circumstances appear to be consistent with a technical problem affecting the aircraft and, at the very least, require an explanation of why an engineer and airport fire crew attended the aircraft and why the aircraft was subsequently towed back to the stand.Your response, however, states that “the delay to your flight was a direct result of air traffic control restrictions”.If that is easyJet’s position, I request evidence establishing the precise causal chain for this particular flight.In particular, please provide or confirm the following:I fully recognise that air traffic management restrictions may, in appropriate circumstances, constitute extraordinary circumstances under UK261.However, the existence of an ATC restriction does not by itself establish that the entire subsequent delay was caused by that extraordinary circumstance. Where several events may have contributed to a delay, the causal contribution of each event needs to be established.In this case, the contemporaneous information communicated to passengers indicates that a technical issue occurred and resulted in a return-to-stand/towing procedure. Your subsequent response attributes the overnight delay instead to ATC restrictions, crew-hours limitations and the Naples curfew.I therefore ask easyJet to explain and document the apparent discrepancy between these two accounts.In particular, I would ask easyJet to provide the evidence relied upon in concluding that the overnight delay was a “direct result” of ATC restrictions, rather than merely a general explanation of ATC disruption in the network.For completeness, I also draw your attention to the established principle under UK261 and the relevant case law that technical problems arising in the normal operation and maintenance of an aircraft do not automatically constitute extraordinary circumstances. The assessment must depend on the specific circumstances and their causal relationship with the delay.If easyJet maintains that an extraordinary circumstance exempts it from paying compensation, I therefore ask it to provide the specific factual and documentary basis for that conclusion in relation to EZY8341/U28341 on 4 September 2026.The flight distance between London Gatwick and Naples falls within the 1,500–3,500 km band under UK261. As the flight arrived more than three hours late, I therefore request payment of the applicable compensation of **£350 per passenger** , unless easyJet can establish that the relevant delay was entirely attributable to an extraordinary circumstance within the meaning of UK261.I also request reimbursement of the reasonable duty-of-care expenses already submitted with my expenses claim, for which receipts were provided.I would appreciate a substantive response addressing the specific events of EZY8341/U28341 rather than a general statement concerning ATC restrictions.If easyJet maintains its refusal to pay compensation, please provide your final written response together with the specific evidence and factual basis relied upon. I reserve the right to refer the matter to AviationADR once the applicable ADR requirements have been met.I look forward to receiving your detailed response.

I was also a passenger on this flight and agree that the crew announced that the delay was as a result of a technical issue (this was related to the brakes) which was announced as the cause of a minor delay before pushback and then resulting in the longer delay which took us back to the stand. The fire brigade were also called to the aircraft while we were waiting on the taxiway for a very long time, and then they followed us back to stand. I have an image of the fire engine out of the window of the aircraft.

My mother in law was flying with us - she is a nervous flyer and was very concerned about the technical issue that the captain announced.

It is simply untrue for Easyjet to say this was as a result of air traffic control delays.

Unbeliavable,they still sticking to their story, ridiculous I don’t know what has to happen to receive compensation. Do let me know what do you think, shall we just go through ADR?

I apologise for the disruption to your flight and understand that your travel plans were greatly affected. We always try to ensure that passengers reach their destinations safely, securely & on time. On this occasion we had no other alternative but to cancel your flight.

After careful consideration and a thorough review of your case, we are sorry to inform you that the reason for disruption of your flight does not qualify for compensation.

The primary reason for the disruption to your flight was outside easyJet’s control and below is the assessment of your claim:
